Because there are no specific statutory requirements, pre-nuptial agreements require little to no financial disclosure and can be difficult to enforce. As your attorney, I always require my clients to disclose their finances and keep nothing hidden to allow for the enforceability of the agreement. For a pre-nuptial agreement, a lawyer must review and sign off on the agreement. This cannot be completed by the attorney who drafted the agreement.
A post-nuptial agreement is usually only done when there have been marital problems and a couple is in the process of separating. The agreement will set forth duties and responsibilities while the couple works on reconciliation. These agreements can be time consuming, cumbersome, and expensive. Statutes regarding post-nuptial agreements are strict and require a detailed financial disclosure of all bank accounts, retirement accounts, assets, debts, and ownership interests.
