For a pre-nuptial agreement, a lawyer must review and sign off on the agreement. This cannot be completed by the attorney who drafted the agreement.

A post-nuptial agreement is usually only done when there have been marital problems and a couple is in the process of separating. The agreement will set forth duties and responsibilities while the couple works on reconciliation. These agreements can be time consuming, cumbersome, and expensive.
