Modification of Family Court Orders in Florida
If you have experienced a job loss or reduction in your income and you are finding it difficult to keep up with your child support or alimony obligation, you must remember that your support obligation does not stop just because your income has been cut. It is necessary to file a Supplemental Petition for Modification because a Florida judge cannot give you relief for support or alimony that accrues prior to the date that you file.
In order to be successful in changing an original court order for support it is not enough that the situation is different for either parent. You must be able to show that the change in the circumstances meets all three legal requirements:
- The change is substantial
- The change is material
- The change is unanticipated
In cases involving modifications of a visitation schedule or custody, the party seeking relief must also show a substantial, material and unanticipated change in circumstances and that a modification of the parenting plan is in the best interests of the minor children. In other words, the Court is not limited to the "best interests of the children" standard which is the determinative factor in the original determination of a proper parenting plan.
