The first case this firm handled in Pennsylvania around in 1982 was an action by an unmarried mother to establish the putative father of the child as the legal parent and arrange for child support. At the core, that is the definition. These cases involve limited issues which include the primary time sharing arrangement for a parent or an equal division of time; the appropriate support award and the tax, health insurance and life insurance considerations attendant in all such matters.
In 1982, simple blood tests were used to determine the parentage of the child. Results ranged from and 80% to a 92% certainty and opened the courts to evidentiary hearings that compared the putative father and the minor child. Juries were employed to render a decision.
Today, we have less intrusive hair sample and skin sample testing which yields such a degree of certainty (99.99%) through the use of DNA testing, that this issue is feasibly resolved in the early stages. The only truly contestable issue which must be addressed is the time sharing arrangement for the parents which, as in divorce, applies the "Best Interests of the Child" standard.
If the case proceeds to statutorily mandated mediation, the issue likely to be at the forerunnner of the meeeting will be when and who will spend time with the kids.
