One of the most important aspects of getting divorced is dealing with child custody and child support issues. These matters often go hand in hand. Whichever parent receives primary custody is generally entitled to some type of support. Child support guidelines and laws, however, are difficult to understand and it is important to contact an attorney to make sure you are paying or receiving the proper amount. Florida Child Support Lawyer

Child support is determined by guidelines put in place by the Florida government. Florida support guidelines are based upon the income of the custodial parent and the income of the non-custodial parent, the cost of health insurance for the children, the cost of daycare and after-school care, and many other factors. What many people do not know is that these guideline amounts can be reduced or adjusted based on various factors. These include:

  • If the non-custodial parent has physical custody for more than 40% of the time (146 overnights), a Florida statute passed in 2003 allows for a substantial reduction in the guideline amount.

  • The guideline can be adjusted 5% higher or lower upon agreement of the parties, or based upon the contact schedule. This is determined by the amount of actual visitation; if visitation is infrequent it can be adjusted upwards, if there is frequent visitation the amount can be reduced.

Child support is the most often modified part of a divorce. In order to modify the amount of support being paid, there must be a basis for the modification. For example, there must be a change in income or a change in the custody arrangement in order for a court to consider changing the support amount. I frequently advise my clients to make automatic disclosure of annual income a part of the divorce agreement. This saves money, allows for greater efficiency in the event of future support disputes, and helps ensure that enforcement of child support is handled properly.
